Learned Advocate for the appellant submits that the entire award amount as per the impugned judgment and award is deposited in this Court.

Considering the above fact, Civil Application deserves to be allowed in terms of prayer clause 'B' and is disposed of.

This is an application for permission to withdraw the amount deposited by the Insurance Company in this Court. 2.

Perused the application. Heard learned Advocates for both the sides.

Learned Advocate for respondent-Insurance Company strongly opposed the application and prayed to reject the application. 4.

Considering the peculiar set of facts and the reasons stated in the application, it would be proper to allow the Civil Application partly. Hence, the following order:

ORDER

a.

Civil Application is partly allowed.

b.

Claimant is permitted to withdraw the 50% amount deposited by the Insurance Company alongwith interest accrued thereon on furnishing usual undertaking alongwith an affidavit to the satisfaction of the learned Registrar (Judicial) of this Court. c.

Civil Application stands disposed of.
