CORAM : RAJNISH R. VYAS, J.
DATE : 25TH FEBRUARY, 2026 PER COURT :
1.
Heard learned counsel for the appellants / original claimants. 2.
These applications are for grant of permission to withdraw the amount deposited by the acquiring body.
2 919 & 920.odt 3.
Learned counsel for the claimants submits that by way of acquisition, claimants were deprived of the property and, therefore, they are entitled for the compensation. He also invited my attention to the order passed by the Co-ordinate bench in Civil Application No. 4333/2023 in First Appeal No. 29240/2021, along with connected matters, in which, the claimants were allowed to withdraw 75% of the amount.
4.
Since the applicants are the claimants and, their land was acquired, I do not find any reason to take a different view from the order dated 03.05.2023, passed in the Civil application and First Appeal stated above. Accordingly, the present applications are partly allowed. 5.
The applicants / claimants are permitted to withdraw 75% of the deposited amount. The applicants shall furnish usual undertaking for withdrawal of 50% amount, for remaining 25% the applicants shall submit solvency to the satisfaction of the Registrar (Judicial). 6.
Civil Applications are disposed of.
