ORDER :

In view of our order dated 05.12.2025, we have received the report from Member, Industrial Court, Aurangabad and Member, Industrial Court Latur.

We have heard all the learned Advocates representing the respective parties.

Learned Member, Industrial Court, Aurangabad appears to have paid visit to plot bearing CTS No.15309 situated at Chhatrapati Sambhajinagar and it has been reported that the said plot admeasuring 1 H 16 R is vacant and it is very much feasible and convenient to the litigants and Advocates. So also, the residence of the Judges of the Industrial and Labour Courts can be adjusted in the said plot. In fact, the said proposal had come from Collector, Chhatrapati Sambhajinagar. Of course, the procedure will have to be undertaken in view of the fact that the valuation of land is more than Rs.50,00,000/- (Rupees Fifty Lakhs) and, therefore, permission of the Government is necessary. When this plot is feasible and convenient from the point of view of the litigants and Advocates, taking into consideration the situation and size, we therefore direct the Collector, Chhatrapati Sambhajinagar to go ahead with the [2]

proposal and take necessary steps for seeking permission of the Government. If he requires help from Industrial and Labour Courts, Chhatrapati Sambhajinagar, then that help to be provided by the learned Member and learned Judge of the respective Courts. Such steps to be taken within a period of one month from today. Since it is to accommodate the Industrial Court, Labour Court and the residences of the Judicial Officers, we expect that respondent No.1/State Government would expedite the matter.

As regards the report submitted by the learned Industrial Court and Labour Court, Latur, it appears that the site was inspected by them along with the officers of Public Works Department and officers of Revenue Department, which was proposed by Collector, Latur. It appears that said spot or site is not suitable according to the Judicial Officers, but according to them there are two plots marked as 'A' and 'B' in the layout plan of the Government Staff Quarter prepared by Public Works Department, which has been annexed here also. It would be suitable for the residential quarters of the Judicial Officers of the Industrial Court and Labour Court, Latur. We direct learned AGP to go through the suitability report that has been submitted and get the instructions, however, at this stage, we would state that in view of the statement made in the report that the revenue officers are not cooperating properly, we express our [3]

displeasure. When it comes to the infrastructure to the Court, all the concerned departments should be cooperative and the revenue authorities will not be justified in not disclosing the Government plots. 5.

Now, as regards the proposed Labour Court site at Dhule is concerned, in our order dated 04.11.2025, on the basis of statement made by learned Government Pleader, upon instructions from District Collector, Dhule, it was recorded that the site would be handed over to the Member, Industrial Court within a period of three weeks from that date. The said statement was taken as undertaking. Now, it is pointed out by the learned Advocate that the said site has not been handed over. We express our displeasure against Collector, Dhule, because upon his instructions the statement was made. Thereafter, if he had any difficulty within a period of three weeks, he ought to have written a letter to Government Pleader. Now, learned AGP is producing copy of letter dated 24.12.2025.

The State had not taken the matter on board at any earlier point of time and now it is informed that when the measurement has been made, there are four to five quarters in existence of police department. Of course, it is stated that it is in a dilapidated condition. Now, every department appears to have waken up and then P.W.D. Engineer and Dhule Police state that their opinion should be taken.

If all, these hurdles were there, why there was a statement on behalf of the State that too on the instructions from District Collector, Dhule that this site is available for the measurement. Then, it is stated that the amount has been deposited to the office of Taluka Inspector of Land Records by the Industrial Court and the measurement was then carried out wherein the members of the bar were also present on 08.12.2025. The copy of the map is now tendered by the petitioner. It appears that the concerned authorities at Dhule have not handled the matter properly and unnecessary statements have been made and now, they are resiling from the same. We direct the Collector, Dhule to remain present with all the details on the next date and also with an offer as to where he can give alternate plot. We reserve our right to impose cost on the State for making such statements and misleading the Court.

Place the matter for further consideration on 29.01.2026. 7.
