The dispute in the present petition is about sanctioning of posts in the school run for special children by the petitioner management. It is the case that in view of G.R. dated 18.08.2004, the staffing pattern is sanctioned. As per the said staffing pattern, the petitioner/school required 10 persons, including teaching and non-teaching staff. It is further case of the petitioner that the petitioner/school recruited 8

Ethape ( 2 ) 929- CA-1937-2026 persons by issuing advertisement in the year 2006. During the course of arguments, it is also pointed out that no objection was raised by the Deputy Secretary, Persons with Disabilities Welfare Department, State of Maharashtra, granting permission to fill up total 14 vacancies. 2.

This Court thus finds that the petition is pending since 2017. In view of this subsequent developments, this court finds that it would be in the interest of the petitioner to make a fresh representation to the Respondent No.3/authorities for sanctioning the posts and further to recruit the posts etc. by following due process of law. 3.

It is open for the petitioner to make an exhaustive representation to the Respondent No.3/authorities. If such representation is made, the the Respondent No.3/authorities to consider the same and take a decision within four weeks thereafter.

With this, writ petition stands disposed off. 5.
