Applicant is praying condonation of delay of 315 days in preferring appeal on grounds stated in paragraph Nos.3 to 10 for condonation of delay. It is submitted that delay is unintentional. Applicant is ready to deposit the amount as directed by this Court on earlier occasion.

Learned counsel for the respondents/claimants opposes the application. It is submitted that unless amount is deposited, delay may not be condoned.

I do not find any reason to discard the grounds mentioned in the paragraph Nos.3 to 10 of the application. I

For the reasons stated above, civil application is allowed in terms of prayer clause "B".
