The present Civil Applications are filed for withdrawal of the amount deposited by the appellant - National Highways Authority of India (NHAI), along with accrued interest.

The learned Counsel for the applicants submits that the Competent Authority for Land Acquisition (CALA) passed an award under Section 3G(1) granting compensation at the rate of Rs. 805/- per square meter. The Arbitrator, under Section 3G(5), enhanced the compensation to Rs. 2,900/- Page 1 of

949 CA 2219-2025 per square meter. The appellant/NHAI challenged the arbitral award by filing an application under Section 34 of the Arbitration and Conciliation Act, 1996, which came to be dismissed. Thereafter, the appellant/National Highways Authority of India has filed the present appeals under Section 37 of the said Act.

It is further submitted that 50% of the differential amount has been deposited in this Court, and the present applications are filed for withdrawal of the said amount by the applicants/ claimants. The applicants / claimants have succeeded before the Arbitrator as well as before the District Court under Section 34.

Considering the above, the applicants / claimants are permitted to withdraw 75% of the amount deposited in this Court, along with accrued interest thereon, subject to filing an undertaking that, in the event the appellant succeeds in the appeals, the claimants shall redeposit the amount so withdrawn.
