The learned A. G. P. appears for the respondent No. 3. 2.

Applicant seeks to condone delay of 960 days caused in preferring first appeal. It is submitted by the learned counsel for the applicant that for the reasons stated in the application, the delay deserves to be condoned. It is further submitted that applicant is ready to give up interest and statutory benefits for the delayed period.

The contents of the application have not been controverted by the respondents. No mala-fides can be inferred on the part of the applicant in preferring appeal belatedly. Applicant is ready
