This is the Application for condonation of 1966 days delay in filing Cross Appeal. The Applicants are the Original Claimants before the learned Reference Court. The Acquiring Body has preferred the Appeal against the Judgment and Award dated 26.06.2019 passed by the learned Reference Court i.e. 7th Jt. Civil Judge, Senior Division, Aurangabad in LAR No.431/2010.

Heard the learned Advocate for the Applicants / Claimants, the learned Advocate for the Acquiring Body and the learned AGP for the Respondent No.2 / State.

There is no dispute that the Acquiring Body has preferred the Appeal against the aforesaid Judgment and Award passed by the learned

Reference Court. Now, the Original Claimants have filed the Cross Appeal along with this Application for condonation of delay. On hearing both the sides and for the reasons mentioned in the Application, the Application is allowed in terms of prayer clause 'B'. The Applicants shall not be entitled to the interest and the statutory benefits for the aforesaid delayed period. Copy of this order be kept in the order sheet of the Appeal memo.
