By order dated 16.06.2025, this Court was constrained to issue bailable warrant against Respondent No.4, returnable today, in the light of the fact that despite of service, there was no response from the said Respondent in the present Petition.

Today, the Executive Engineer of the Irrigation Division, Beed i.e. Respondent No.4 himself is present in this

(( 2 )) 906-WP-14028-2021 Court and Mr. Solshe, learned counsel having instructions to appear on behalf of the said Respondent, submits that Vakalatnama can be immediately filed. An unconditional apology is tendered on behalf of Respondent No.4.

In that light, a prayer is made for recalling the order issuing the order issuing bailable warrant against Respondent No.4. 4.

Considering that Respondent No. 4 is present in person, and regretting the lack of response earlier, this Court is reluctantly agreeable to the withdrawal of the order of bailable warrant. Accordingly, the order issuing the bailable warrant is recalled. 5.

The Vakalatnama and reply affidavit on behalf of Respondent No.4 shall be filed within one week from today. 6.

List for further consideration on 12.08.2025, in the 'urgent orders' category.
