This is an application for condonation of delay of 390 days caused in filing the first appeal.

Heard the learned counsel for the applicant and the learned counsel for respondent No.1. Perused the application. The learned counsel for respondent No.1 strongly opposed the application and submitted that the reasons given in the application are not acceptable and sufficient to condone the delay as contemplated by Section 5 of the Limitation Act. It is submitted to reject the application. On perusal of the application, it appears that the delay is not deliberately caused.

For the reasons stated in the application, the delay stands

916 ca.3030.25.odt condoned. The application stands allowed in the interest of justice. Appeal be registered.

Issue notice to the respondents, returnable on 25th June, 2026. Mr. Cheble, learned counsel waives notice for respondent No.1. Call for record and proceedings.
