Heard learned counsel for the applicant. None appears for the respondents though duly served.

Present application is for condonation of delay of 64 days in preferring appeal challenging judgment and award dated 12.09.2024 passed in MACP. No.62 of 2023. 3.
Learned counsel for the applicant submits that for the reasons stated in paragraph Nos.2 to 4, delay caused in preferring appeal needs to be condoned. There are no malafides on the part of the applicant. He would further submits that today he is armed with cheque of the amount
127-CA.3636-25.odt which was directed to be deposited while granting him adinterim relief by order dated 02.04.2025. 4.
I do not find any reason to discard the grounds mentioned in the civil application. Applicant is armed with the cheque of the amount of award.

Civil application for delay is allowed in terms of prayer clause "B".

Office shall register first appeal.

Call for Record and Proceedings from the concerned Court.

Office is directed to accept the cheque if deposited within a period of three (3) days from today. In Civil Application for stay 10.
