Heard learned advocates appearing for the respective parties.

Mr. Patil, learned advocate appearing for applicant invites attention fo this Court to the order dated 28.6.2024 passed in sister appeals arising out of same acquisition, by which 75% amount deposited by the acquiring body is permitted to be withdrawn on usual terms and balance 25% amount is directed to be invested in fixed deposit. In that view of the matter, same course can be adopted in the present matter. In the result, application is allowed as under.

O R D E R

I.

Applicant is permitted to withdraw 75% of the amount deposited in this Court alongwith accrued interest thereon on furnishing usual undertaking to the satisfaction of the Registrar

ca 3984.25+.odt Judicial of this Court. Balance 25% of the amount of compensation with accrued interest thereon be invested in fixed deposit in any Nationalized Bank for a fixed term to be renewed till pendency of the appeal.
