Learned Advocate for the applicant submits that applicant is paying the maintenance amount @ Rs. 30,000/- per month as per the orders passed in DV Act proceedings. He is ready to deposit the 50% arrears of maintenance i.e. Rs. 82,500/-, for the present. He has undergone Hernia operation and his father is required to undergo dialysis on daily basis. He further submits that as per the directions of Trial Court, he has already deposited the
921 CA NO.4918.2025 Crctd -2amount of Rs. 1,42,000/- towards the educational expenses of his daughters and he has undertaken to pay the educational expenses demanded by the college.

For the present, appellant is permitted to deposit 50% amount of the arrears of maintenance within four weeks from today but the applicant shall continue to pay monthly maintenance of Rs. 55,000/- as directed by the Trial Court by deducting the amount of maintenance being paid in DV Act proceedings. 3.
Subject to above condition, the decree passed by the Trial Court in respect of maintenance shall remain stayed until further order.

Since the present appeal is filed within limitation, Civil Application No. 4917 of 2025, filed for delay condonation, is disposed of.

At the request of learned Advocate for respondent, place the original F.C.A. No. 37 of 2025 for further consideration on 18.06.2025.
