This is the Application filed by the Respondent / Orig. Claimant in Appeal for withdrawal of 50% amount deposited by the Acquiring Body in this Court along with interest accrued thereon. 2.
The land of the Applicant / Orig. Claimant was acquired by the Acquiring Body for the construction of Minor Irrigation Tank, Mundkheda, Tal. Chalisgaon, Dist. Jalgaon in the proceeding bearing LAQ/SR-No.44/04.

The learned Advocate for the Applicant submits that this Court by orders dated 28.04.2025 in Civil Application No.4097 of 2025 in First Appeal (St.) No.7768 of 2021 and in Civil Application No.4107 of 2025 in First Appeal (St.) No.6424 of 2021, arising out of the same acquisition proceedings, has permitted the Applicants therein to withdraw 50% amount on furnishing usual undertaking to the satisfaction of the Registrar (Judicial) of this Court and the same order may be passed on this Application also.

Though the learned Advocate for the Acquiring Body opposes the Application, he does not dispute the aforesaid factual aspect that this Court has permitted similarly placed applicants to withdraw 50% amount, by the aforesaid orders.

On hearing both the sides and considering that the similarly situated Applicants / Claimants have already been permitted to withdraw 50% amount along with interest accrued thereon, this Application is allowed in terms of prayer clause 'B', subject to the condition that the Applicant shall furnish usual undertaking to the satisfaction of the Registrar (Judicial) of this Court. 6.
Application stands disposed off accordingly.
