Applicants seek to withdraw amount of Rs. 8,46,148/- deposited by the respondent - acquiring body. It is submitted that only 70% of the compensation amount with accrued interest has been deposited. It is further contended that the respondent - acquiring body withdrew the appeals arising out of identical acquisition process.

Learned counsel for the respondent No. 3 - acquiring body submits that the enhancement is exorbitant and more than ten times. It is submitted that the appeals which were withdrawn are falling within the realm of policy of the Government as the
2 16 ca 5208.25 enhancement was less than four times. It is submitted that if the entire amount is disbursed, prejudice would be caused to the respondent - acquiring body.

In pursuance of order passed by this Court only 70% of the amount with accrued interest is deposited by the acquiring body. Balance amount is still withheld. The grievance of exorbitant enhancement can be taken care of by the amount withheld. I find it appropriate to permit the claimants to receive the amount with accrued interest.

The civil application is allowed partly permitting the applicants to receive the amount with accrued interest on furnishing undertaking to the satisfaction of the Registrar (Judicial) of this Court. The civil application is disposed of. [ SHAILESH P. BRAHME J. ] bsb/Feb. 26
