1] The present Civil Application is filed for condonation of delay of 35 days in filing the Second Appeal. 2] The learned counsel for the respondent nos. 1 and 2 Mr.Chaure opposes the prayer for condonation of delay.

3] However, in the interest of justice, for the reasons stated in para nos.3 and 4 of the application for condonation of delay, the delay of 35 days in filing the Second Appeal is condoned subject to cost of Rs.3,000/- to be deposited to the Bar Library, Advocates Association, High Court Bench at Aurangabad within a period of one week.

5486.25CA 4] Upon deposit of aforesaid cost, Second Appeal shall be registered on the file of this Court and to be heard along with Second Appeal No.422/2024 on the next date of hearing, that would be on 26.02.2026.

5] Interim arrangement which is recorded as per the statement of the respondent no.1-Vimalbai, in its order dated 9th December, 2024 in Second Appeal No.422/2024, is continued till the next date of hearing.
