Applicant is seeking condonation of delay in bringing legal heirs of respondent No.2 on record. It is submitted that respondent No.2 Mohan Daulat Landge died on 18.09.2024. His heirs are shown in paragraph No.3 of the application. The cause of action survives against them. They are necessary parties.

For the reasons stated in the application, I am inclined to allow the application.

Civil application is allowed by permitting the applicants to bring legal heirs of respondent No.2 on record by condoning delay and setting aside the abatement.
