The applicant/mother has filed Civil Application No.5951 of 2025, inter alia praying that the custody of the child be returned to her since surgery of the child was not performed as earlier scheduled.

The respondent/father has filed an affidavit dated 12.06.2025, stating that the surgery could not be performed because the child is suffering from moderate acute malnutrition. He has placed on record certain documents from MGM Medical Center and Research Institute, Aurangabad regarding some investigations, which were undertaken. The respondent has today tendered across the bar Admission Request Form and Admission Form from

902-ca-5951-2025 Kokilaben Dhirubhai Ambani Hospital and Medical Research Institute, Mumbai showing that the child is admitted on the said hospital on 16.06.2025. The said documents comprising of three pages are taken on record and collectively marked as Exh.-X for identification.

The learned Counsel for the applicant/mother in fairness admits that the respondent/father had appraised her about the child being shifted to Kokilaben Dhirubhai Ambani Hospital, Mumbai.

The learned Counsel for the respondent/father reiterates the stand that he will allow the mother to have unlimited access to the child as promised earlier. 5.

Since, the child is admitted in a hospital at Mumbai and the respondent/husband has again reiterated his stand that the mother will be given unlimited access to the child, list the application for further consideration on 25.06.2025 with liberty to both parties to circulate the matter if any contingency arises.
