Applicants who are claimants are praying for withdrawl of amount deposited in distinct appeals by the respondent/Acquiring body. It is submitted that arising out of self-same notification under Section 4 and the project, an order was passed on 17.04.2025 permitting the applicants to withdraw 75% amount with accrued interest on furnishing undertaking and the balance amount was directed to be deposited.

Learned counsel for the respondents have no serious objections for following the same course. It is pointed out by learned counsel for the acquiring body that distinct amounts are deposited in the appeals in pursuance of the conditional orders of stay. 3.
I propose to follow the same course as it was done by the coordinate bench in the group of appeals in Civil Application No.4058 of 2025 in First Appeal No. 1379 of 2024 and connected matters. 4.
I therefore pass following order :
ORDER
i) The applications are partly allowed and disposed off. ii) The applicants are allowed to withdraw 75% of compensation
3 37(i).CA-6181-2025.doc amount with accrued interest deposited in this Court on furnishing usual undertaking to Registrar (Judicial) of this Court, which shall be made part of appeal record.
iii) Balance 25% of the amount be invested in fixed deposit in any Nationalized Bank to be renewed from time to time till the disposal of the appeal/s.
iv) In case of First Appeal No.1383 of 2024 any inquiry in respect of the undertaking to the extent of Sindhubai Prakash Shinde shall be conducted through her son Somnath Prakash Shinde. [ SHAILESH P. BRAHME, J.] vsj..
