This is an application for condonation of delay of 279 days caused in filing the first appeal.

Heard the learned counsel for the applicant. Perused the application.

The learned counsel for the applicant submits that, due to financial constraints, the applicant could not arrange funds for payment of court fees and advocate's fees and, therefore, could not file the appeal within the period of limitation.

On perusal of the application and for the reasons stated therein as well as considering the period of delay, this Court is of the view that the applicant has established sufficient cause, as contemplated under

912 ca.6300.25.odt Section 5 of the Limitation Act, for condonation of delay of 279 days in filing the first appeal. Accordingly, the delay stands condoned. The application stands allowed in the interest of justice. Appeal be registered.

Appeal:

Issue notice of final disposal to the respondents, returnable on 26th February, 2026. Mr. Maniyar, learned counsel waives notice on behalf of respondent No.2.
