Applicant seeks withdrawal of amount of Rs.31,60,335/- deposited by the respondent - Acquring Body.

My attention is adverted to order dated 08.12.2025 passed by this Court in CA / 13467 / 2025. In that case, only 75% of the

2 966 amount was deposited and entire amount was directed to be disbursed.

In the present case, it would be pragmatic to allow applicant to receive 75% amount.

The Civil Application is partly allowed permitting the applicant to receive 75% of the amount with accrued interest on furnishing undertaking to the satisfaction of the Registrar (Judicial) of this Court. Balance amount shall be invested in any Nationalized Bank.

DELAY 5.

For the reasons stated in the application and which are not disputed by the respondents, delay stands condoned. C.A. disposed of.

STAY 6.

As the entire amount is deposited by the Acquiring Body, interim stay granted shall stand confirmed. Civil Application is disposed of.
