The civil application No. 6754 of 2025 is filed for condonation of delay of 397 days caused in filing the first appeal. 2.
Perused the application and heard learned advocates for both sides. Learned advocates for respondents strongly opposed the application and submitted that there is no sufficient reason to condone the delay. On perusal of application and more particularly, paragraph Nos. 4 and 5 thereof, it appears that on account of permanent disability and financial crises, the applicant could not file appeal within limitation. This shows that the delay is not deliberate or intentional. The application therefore, deserves to be allowed and it is accordingly allowed. The delay caused in filing appeal is
ca6754.25 -2condoned in the interest of justice.

In first appeal, issue notice to the respondents, returnable on 20.02.2026. Call for record and proceedings. 4.
Learned advocate for the appellant has pointed out the order of this Court dated 04.12.2025, by which directions were given to the learned Motor Accident Claims Tribunal, Aurangabad for carrying out correction in the name of respondent No.1 as per the judgment. It appears that more than two months are over but the necessary corrections are not carried out. The Registrar (Judicial) of this Court is directed to communicate this order to the learned Motor Accident Claims Tribunal, Aurangabad and get it corrected till the next date.
