This is an Application for withdrawal of the amount under the Award deposited by the Acquiring Body before the Executing Court. 2.

Heard the learned Advocate for the Applicants/Claimants and the learned AGP for the State as well as the Acquiring Body. 3.

It is not in dispute that the enhancement made by the learned Reference Court is within four (4) times of the compensation granted by the Special Land Acquisition Officer. The total amount under the Award is Rs. 2,78,918/-. The Applicants are ready to give their undertaking against the withdrawal.

In view of the above, the Application is allowed subject to furnishing regular undertaking before the Executing Court. 5.

Learned Advocate Mr. Shubham Jayabhar for the Applicants / Claimants submits that, for prayer clause 'C', he will move an appropriate application before the Executing Court for correction of the name of Applicant No. 3 - Tulshiram Dagadu Shevale, which wrongly came to be typed as Tulsabai Dagadu Shevale in the Reference. 5.1.

Liberty is granted to move such an Application. 6.

The prayer clause 'C' in the said Application be deleted forthwith.

The Application stands disposed off.

CIVIL APPLICATION NO. 7044 OF 2025: - 1.

This is an Application for withdrawal of the amount deposited by the Acquiring Body under the Award before the Executing Court.

The learned Advocate for the Applicants/Claimants submits that, the Executing Court has permitted the similarly placed claimants to withdraw the entire amount on furnishing regular undertaking.

The learned AGP seeks time to verify the said aspect. 3.
