Appellants seek to condone delay of 943 in setting aside abatement and bringing legal heirs of Vijay @ Vijaya Dadarao Godase (Mane) on record.

The cause of action survives as against the legal heirs of the deceased. They are necessary parties. There is no reason for filing the application belatedly. The delay stands condone, abatement is set aside. Leave is granted to carry out the amendment.
