DATE : 05.01.2026 PER COURT :- .
This appeal has been preferred by the acquiring body against the impugned judgment and award passed in L.A.R.No.108 of 2020. 2.
It has been pointed out by learned counsel for the claimants that filing of the appeal is against the policies because the enhancement granted by the Reference Court is within four times. My attention is adverted to paragraph 4 and 5 of affidavit in reply preferred by the State Government. 3.
Learned AGP fairly concedes that the appeal should not have been filed because the enhancement for fruit bearing trees was within four times. Present case is squarely covered by Government Resolution dated 03.11.2016, 23.02.2017, 13.08.2018 and 22.02.2024.
( 2 ) 67 CA 7856 OF 2025 4.
By way of impugned judgment and award, no enhancement has been granted to the land. The enhancement granted to the fruit bearing trees is within four times. In that view of the matter, there is no reason to entertain the First Appeal.
O R D E R
