2] Civil Application No.8417/2025 in Arbitration Appeal Stamp No. 23543/2025 is filed to condone the delay of 08 days in filing the Arbitration Appeal. For the reasons stated in the Civil Application, the same is allowed. Delay of
08 days is condoned. Arbitration Appeal be registered. Civil Application is disposed of accordingly.
3] This Court, by order dated 1st April, 2026 has decided the Arbitration Appeal No.103 of 2025 along with connected Appeals, arising out of village Kothali, District Jalgaon. The evidence is common and the compensation granted by the CALA as well as Arbitrator being the same. The facts are identical, as such, the order dated 1st April, 2026 passed by this Court in Arbitration Appeal No.103 of 2025 along with connected Appeals would be applicable to the present matter also. Considering the same, the Arbitration Appeals are dismissed in terms of order dated 1st April, 2026 passed by this Court in Arbitration Appeal No.103 of 2025 along with connected appeals.
4] In view of the orders passed in all the Arbitration Appeals, all Civil Applications seeking withdrawal of the amounts are also allowed. However, since the National Highway Authority intends to challenge this order, the applicants shall furnish an undertaking to this Court stating that in the event any faourable order is passed in favour of the National Highway Authority, they will redeposit the amount withdrawn within a period of four weeks.
5] All other pending Civil Applications for interim relief/stay stands disposed of.
