This is the Application for condonation of 502 days delay in bringing the legal representatives of Deceased Respondent No.6 on record.

Learned Advocate for the Applicants submits that, Respondent No.6 expired on 24.11.2023. It is further submitted that the Applicants were not aware of the demise of Respondent No.6, as he was residing at Chhatrapati Sambhajinagar and upon gaining knowledge of the said fact, the present Application has been filed. He, therefore, submits that, the Application be allowed.

The Application is opposed by learned Advocates appearing for the Respondents. It is submitted that, plausible explanation has not been offered by the Applicants for condonation of inordinate delay of 502 days and therefore, the Application be rejected.

In view of the above submissions as well as for the reasons cited in the Application, the Application is allowed. Delay of 502 days is condoned. Abatement, if any, stands set aside. The Applicants are permitted to bring legal representatives of Respondent No.6 on record. Amendment be carried out accordingly. Application stands disposed of. (VAISHALI PATIL-JADHAV, J.) ( ARUN R.
