Present application is for condonation of delay, setting aside abatement and bringing heirs of the appellant No. 2 on record.

The cause of action survives against heirs of the deceased appellant No. 2 - Trimbakappa Ramlingappa Vyavahare. They are necessary parties.

For the reasons stated in the application, it is desirable to

The civil application is allowed in terms of prayer clauses 'B' to 'D'. The civil application is disposed of. 5.
