This Civil Application for condonation of delay of 49 days caused in filing First Appeal.

The applicant seeks condonation of the delay on the explanation expressed in the Civil Application. 3.

The matter be listed after service of notice is complete. In the meantime, applicant shall take recourse to the provisions enumerated in Chapter II of the Bombay High Court Appellate Side Rules, corresponding to the stage and requirement of matter.

Mr. Mundada, learned counsel for the applicant submits that the award amount payable, together with interest, has been deposited in the Trial Court as condition precedent to lodge the present appeal. He further submits that if such amount is withdrawn by the claimants, the very purpose of filing the First Appeal would be frustrated. He also submits that the appeal raises substantial questions of law that ought to be considered on its merits by this Court. 4.
In view of the above, learned Commissioner for Employees Compensation and Judge, Labour Court - II, Ahmednagar [Application (WC) No. 6 of 2019] is directed not to disburse the deposited amount without any order from this Court.
