Mr. Mrigesh Narwadkar, learned Advocate for the Petitioner submits that during the pendency of the petition, the original Petitioner-Smt. Padmatai Chintamani Maharaj has expired and her legal heirs have already been brought on record. Tauseef

Learned Advocate for the Respondent has filed objections in that regard. However, in view of the fact that Smt. Padmatai Chintamani Maharaj is no more and without entering into the merits of the matter, in my opinion, the matter deserves to be relegated to the Sub-Divisional Officer, Vasmat.

Accordingly, the order dated 19.08.2022 passed by the learned Maharashtra Revenue Tribunal, Aurangabad in Case No.98B2020-Hingoli as well as the order dated 16.01.2020 passed by the Deputy Collector (Inam Abolition), Hingoli and order dated 13.12.2017, the Sub-Divisional Officer, Vasmat are hereby quashed and set aside.

Hence, the present petition is disposed of.

The Sub-Divisional Officer, Vasmat shall consider the objections of all parties and decide the matter afresh in accordance with law, after granting an opportunity of hearing to all concerned and without being influenced by the earlier orders. 7.
All contentions of the parties are kept open. 8.
