Applicants seek to condone delay of 7184 days in preferring the appeal.

Learned counsel for the applicants submits that his clients are ready to give up the interest and statutory benefits for the delayed period. It is submitted that original claimant Sonabai died and even her son also died. Grandsons are prosecuting the matters. The delay is sought to be condoned for the reasons stated in the application.

Application is contested by learned AGP. It is submitted that no adequate reasons are mentioned and the application is liable to be rejected.

Applicants are ready to give up the interest and statutory benefits. The averments have not been controverted by the respondent as such the ends of justice would be met by imposing costs.

The delay stands condoned on condition that the applicants shall not be entitled to the interest and statutory benefits for the delayed period and additional cost of Rs.5000/- is imposed, which shall be a condition precedent to be paid to the respondent within four (4) weeks from today.
