The learned counsel for the appellant is directed to bracket name of respondent No.4.

The amendment be carried out within a period of two weeks from today. If the amendment is not carried out within a stipulated period of time, the applicant/appellant has to pay costs of 2,000/-.

This is an application seeking for condonation of delay of Shrikant Malani

918.1.CA.12328.2025 128 days caused in filing the first appeal.

The learned counsel for the respondents strongly opposed the application and submitted that there is no sufficient reasons to condone the delay.

Perused the application. For the reasons stated therein, the application deserves to be allowed in the interest of justice as the delay is neither deliberate nor intentional. Hence the following order:

O R D E R

(a) Civil application is allowed.

(b) The delay of 128 days caused in filing the first appeal is hereby condoned.

(c) The application is disposed of.
