The applicants are seeking direction for depositing 40% of the amount with accrued interest. The learned counsel for the applicants submits that only 60% of the amount was directed to be deposited. Balance amount has not been deposited. My attention is adverted to the findings recorded by the Reference Court awarding the enhancement on the ground of parity. 3.

Per contra, learned counsel for the respondent No.3 would point out 1/2

965 CA 12501 25+.odt that in the first appeal arising out of L.A.R. No. 308/2018 and other matters similar type of applications were disposed of vide common order dated 18.10.2024. It is submitted that the enhancement is more than 33 times. The applicants are already disbursed 60% of the amount with accrued interest.

I have gone through the judgment passed by the reference Court. It is apparent that enhancement is more than 33 times. In similarly situated matters this Court did not accept the prayers for direction to deposit further 40% of the amount. Already the applicants are disbursed the amount with accrued interest. It is informed that there are about 60 to 65 first appeals preferred by the Acquiring Body. It would be better to hear appeals finally. 5.

The Civil Applications are rejected.

If no steps are taken by the Acquiring Body to club and list the matters for final disposal, it would be open for the applicants to renew the request. ( SHAILESH P. BRAHME, J.) mkd/- 2/2
