The present application is filed by the applicants, seeking condonation of delay of 1290 days in filing the present Civil Application for restoration of the Second Appeal, which came to be dismissed by the conditional order passed by the Registrar (Judicial) on 09.03.2022 for non-removal of office objections. At the relevant time, the Second Appeal was only on stamp number and was not registered.

The applicants have stated that the learned counsel appearing earlier did not inform them about the conditional order dated 09.03.2022 and did not take steps to remove the office objections, due to which the Second Appeal came to be dismissed. Jhs/ 1/2

Taking into consideration the reasons stated in the applications and the submissions advanced, the delay of 1290 days in filing the present Civil Application stands condoned, subject to the applicants paying costs of 10,000/- to the High Court Bar Association Library ₹ and 5,000/- ₹ to be paid to the office of the Union of India through the learned counsel appearing for the Union of India in the present application.

Upon deposit of the aforesaid costs, the Second Appeal shall be restored.

The applicants undertake to remove all office objections within a period of three weeks from today.

The Second Appeal shall be listed for final hearing after removal of office objections.
