Learned counsel Mr. Mundhe has instructions to appear for legal heirs of deceased respondent No.1. The cause of action survives as against the legal heirs of the deceased. They are necessary parties. The delay stands condone, abatement is set aside, legal heirs are permitted to be brought on record. 4.
