The petitioner had secured the admission as against a reserved post and completed the education of B.A.M.S. degree. The Respondent/Scrutiny Committee invalidated the petitioner's tribe claim. The petitioner has, therefore, filed the present Writ Petition challenging the said order of invalidation.

The petitioner has now moved this Civil Application seeking return of the B.A.M.S. Degree Certificate, Leaving Certificate, SSC Mark sheet, HSC Mark sheet and other original documents. Narwade

Mr. Aghav, learned Counsel appearing for Respondent No.3, opposes this Civil Application, contending that the petitioner had secured admission from the reserved category and, though not fullfilling the requisite criteria laid down for the purpose of seeking admission, he has completed the course. Therefore, the petitioner is not entitled to return of the documents as prayed for. 5.

The petitioner is ready to furnish an undertaking stating that henceforth he will not seek admission for the higher course from reserved category, we accept the said statement. This Court has passed similar orders directing the return of original documents after obtaining such undertakings from the concerned petitioners. One such order has been placed on record passed in Civil Application No.10681 of 2025 in Writ Petition No.8442 of 2021 dated 29.09.2025. 6.

In that view of the matter, after furnishing the undertaking before this Court within a period of two (2) weeks from today, we direct the concerned respondents to return petitioner's respective documents after retaining certified copies thereof. 7.
