By this civil application the petitioner seeks to challenge the termination order issued by the respondent - employer dated 14.11.2025. Admittedly, this Court while issuing notice in the writ petition on 15.10.2025, have protected the service of the petitioner by directing the employer not to take coercive action against the petitioner solely on the ground of invalidation of his tribe claim.

It seems that due to some communication gap between the petitioner and the employer the impugned termination order has been effected. We find that in peculiar facts and circumstances of the case the service of the petitioner needs to be protected by allowing this Civil Application in terms of prayer Clause 'B'. 3.

We make it clear that the petitioner may be entitled for continuation of service but will not be entitled for the back-wages for the period from which his service is brought to an end till he is reinstated. We expect the respondent - employer to reinstate the petitioner within a period of eight (8) days from today. With this direction, the Civil Application stands disposed of. (ABASAHEB D. SHINDE, J.)
