DATE : 18.12.2025 PC :- 01.
This application is moved for withdrawal of amount deposited in the office of this Court, during the pendency of the Writ Petition. The parties are now before the Hon'ble Supreme Court. The Hon'ble Supreme Court passed an order dated 25.07.2025 and thereby refused to grant stay to the reinstatement part of the order. However, to the extent of back wages, stay is granted subject to depositing 50% amount of back wages before the Registry of the Hon'ble Supreme Court. Liberty is thereafter granted to the present applicants to withdraw 50% of the amount, so deposited. Further, it is made clear that 50% of the amount of back wage shall include the amount which has already been deposited in this Court, which is stated to be Rs. 70 lakhs. 02.
This Court finds that when part of the amount is deposited in the Hon'ble Supreme Court and the SLP is pending, it would not be proper to pass order of withdrawal, when petition before this Court is already disposed off and no proceeding is pending before this Court.
( 2 ) ca13779.25 03.
It would be proper on the part of the applicants to file application in the Hon'ble Supreme Court for withdrawal of the amount, if so advised.
04.
The Civil Application is accordingly disposed off. [KISHORE C. SANT,J.] snk/2025/Dec25/ca13779.25
