This is an application for permission to withdraw the amount of compensation deposited in this Court as per the impugned judgment and award.

Perused the application. Heard learned Advocates for both the sides.

Learned Advocate for respondent strongly opposed the application and submitted that there is contributory negligence on the part of claimant. He further submitted that there is no functional disability sustained to the applicant. He therefore prayed to reject the application.

On perusal of the application and impugned judgment, it is crystal clear that it is the case of the regular accident. All other aspects will be considered on merit at the final hearing of the appeal.

927-ca-14009-2025 -2Considering all these aspects, the application deserves to be partly allowed. Hence, the following order:

ORDER

a.

Civil Application is partly allowed.

b.

Applicant is permitted to withdraw 50% amount deposited by the Insurance Company in this Court alongwith interest accrued thereon on furnishing usual undertaking to the satisfaction of the learned Registrar (Judicial) of this Court.

c.

Civil Application stands disposed of.
