The applicant is seeking extension of time to finally decide Regular Civil Suit No. 59/2009, which is directed to be decided within five months from 16.10.2025.

It is submitted that it is very difficult to conclude the proceedings within the stipulated period as the applicant was required to amend the plaint and implead the parties. The applicant seeks extension of further two months for conclusion of the proceedings.

The learned counsel for the respondents brings to the notice of this Court that the applicant failed to appear on 16.10.2025, when it was specifically directed by this Court vide judgment dated 25.09.2025 passed in Second Appeal No. 539/2021. She and her lawyer did not appear on the subsequent dates also. She was also required to be issued notice by the Trial Court and ultimately the appearance was caused on 24.11.2025. 1/2

The conduct of the applicant is depricable. She has flouted the directions issued by this Court. Had she appeared on 16.10.2025, time of one month could have been saved and utilized for the proceeding. As a last indulgence, this Court is extending the time for conclusion of the trial. 6.

The proceedings of Regular Civil Suit No. 59/2009 pending before the Civil Judge Junior Division, Devani, shall be concluded by the end of May 2026. The applicant shall cooperate with the Trial Court for expeditious disposal of the matter, failure of which shall entail a stringent action against her.
