This is an application for condonation of delay in preferring an appeal for bringing legal heirs on record, so also setting aside the abatement order.

The delay caused is of 2156 days. The learned counsel for the applicant submitted that as the legal heirs were not aware about Shrikant Malani

931.CA.14167.2025 the pendency of the present proceedings, an appropriate application could not be moved. She further submitted that the delay caused is not intentional but bona fide and the appeal is preferred by the acquiring body challenging the award passed by the Reference Court. 3.

Considering the fact that cause of action still survives and the delay has been properly explained by way of preferring civil application, delay is condoned. Consequently, abatement order, if any, is set aside.

The legal heirs be brought on record within a period of two weeks from today.
