Mr. Pandit Kasar, Advocate for the Petitioner. Mr. Shruti Mehta and Mr. Mustafa Bohra i/b. M/s. Solomon & Co., Advocate for the Respondent.

Ms. Meenaz Kakalia, as Amicus Curiae, present.

CORAM:

BHARATI DANGRE & MANJUSHA DESHPANDE, JJ.

DATED:

13 JANUARY 2026.

PC:- 1.

The Contempt Petition is already disposed of by order dated 22.09.2025. Today the petition is listed for compliance. The Court Commissioner Ms. Meenaz Kakalia, who was appointed to resolve the dispute, is in possession of the Demand Draft (DD) in the sum of Rs.18 lakhs. However, this Demand Draft was to be handed over to the wife, on the date of execution of the transfer deed in respect of the premises situated at Vasant Vihar, Chembur, Mumbai, in terms of the Supplementary Consent Terms. However, it appears that the transfer is taking some time because, Digitally signed by RAJESHRI PRAKASH AHER Date:

903 CP 8 OF 2026.DOC sort out the issue once they have executed the Consent Terms and Supplementary Consent Terms and act accordingly. 2.

The Contempt Petition alleged disobedience of the original Consent Terms dated 12.07.2025. During its pendency, the parties executed Supplementary Consent Terms, which were placed before the Court.

We expect the parties to act thereupon. Further, since we find that the respondent is not in willful disobedience of the consent terms and even as far as supplementary consent terms are concerned though some additional steps are required to be taken for transferring the property and as stated by the learned counsel for the contempt petitioner, there will have to be paper publication which may consume certain time, we direct the Court Commissioner to hand over the Demand Draft to the petitioner, who shall once again prepare a fresh Demand Draft in compliance with the Supplementary Consent Terms dated 22.09.2025, when the transfer is effected in his favour.

3.

In the wake of the aforesaid, since the contempt proceedings are already disposed of, we do not pass any further orders. (MANJUSHA DESHPANDE, J.) (BHARATI DANGRE, J.) { Rajeshri Aher
