Heard the learned counsel for the applicant.

On 28.02.2025, this Court passed an order and issued notice to the non-applicant and granted ad interim relief in terms of prayer clause (C).

As per the office note, the notice was served to the non-applicant through his mother, but he failed to appear in the matter. Therefore, on 18.08.2025, fresh notice for final disposal was issued. Despite of service of notice, the non-applicant failed to appear.

By the present application, the applicant / wife is seeking transfer of the petition No.A-2312 of 2024, filed by the non-applicant for restitution of conjugal rights from the file of learned Family Court9, Pune, to the Court of learned Civil Judge, Senior Division, Shrirampur, District Ahmednagar.

On perusal of the application, I have satisfied that the applicant has made out substantial ground and considering the convenient of the present applicant, it is necessary to withdraw Petition No.A-2312 of 2024 from the file of learned Family Court 9, Pune to the file of learned Civil Judge, Senior Division, Shrirampur, District Ahmednagar.

Accordingly, the Miscellaneous Civil Application is allowed.

Petition No. A-2312 of 2024, from the file of learned Family Court 9, Pune is hereby withdrawn and it is transferred to the learned Civil Judge, Senior Division, Shrirampur, District Ahmednagar for proper adjudication.
