This Contempt Petition is filed alleging that Respondent Nos. 1 to 3 have willfully disobeyed the order dated 20th December 2024 passed by this Hon'ble Court in the aforesaid Writ Petition. It is specifically contended that paragraph 27 of the said order has not been complied with, amounting to an intentional breach of the directions issued therein. Paragraph 27 of the said order reads thus:

"27. In these circumstances, we have no hesitation in allowing both the Writ Petitions and directing the MIDC to execute the requisite agreements to lease, within a period of six weeks from today, and to hand over physical possession of the respective allotted lands to the Petitioners."

During the pendency of this Petition in pursuance of the order passed by this Court, the MIDC has already executed agreement to lease with the Petitioner. As also physical possession of the respective allotted land is handed over to the Petitioner. In this view of the matter and in our opinion, as the contention of the Petitioner of the intentional disobedience does not survive, the Contempt Petition is accordingly disposed of.

However, All rights and contentions of the Petitioner under the lease agreement or any action to be taken thereunder in respect of the alloted land, are expressly kept open. Needless to observe that all contentions of the Respondent also in that regard are kept open.

The Contempt Petition stands disposed of in the aforesaid terms. In view disposal of the Contempt Petition, nothing survives in any pending application therein, and the same is accordingly disposed of. (AARTI SATHE, J.) (G. S. KULKARNI, J.) Laxmi
