The contempt petition alleges willful disobedience of the order dated 22 July 2024 passed by the Family Court, Pune. 2.
It is well settled in law, as laid down by the Supreme Court in Kanwar Singh Saini vs. High Court of Delhi, (2012) 4 SCC 307, that in cases alleging willful disobedience of an order passed by a subordinate court, the appropriate remedy for the aggrieved party is to approach the very same court which passed the order. Such party may seek appropriate reliefs under the provisions of Order 39 Rule 2A of the Code of Civil Procedure, 1908, or Order 39 Rule 11 thereof, or any other remedy as may be permissible in law. 3.
In view of the above, all contentions are kept open to be agitated before the competent subordinate court.
