The Contempt Petition alleges breach of Consent Terms dated 11 July 2019 and the Consent Decree passed by the Appellate Bench of the Small Causes Court dated 3 March 2022 based on the Consent Terms. It appears that the Petitioner has already filed proceedings for execution of the Consent Decree. In that view of the matter, this Court is not inclined to exercise contempt jurisdiction in the facts of the present case. However mere refusal by this Court to exercise contempt jurisdiction would not ipso facto absolve the Respondents of acts committed by them, if any, contrary to the Consent Terms.
