In spite of service, none appeared on behalf of the non-applicant. However, the non-applicant has filed reply affidavit through his counsel Mr. Sameer Daruwala. 3.

Having heard to the submissions canvassed on behalf of both the parties, I have gone through the record. 4.

By the present application, the applicant / wife prays for transfer of Petition No.A-436 of 2024 from the file of learned Principle Judge, Family Court, Aurangabad to the learned Family

(( 2 )) 924-MCA-136-2025 Court, Jalna, on the ground that after discord of the matrimonial relations, she started residing at her parental house, within the jurisdiction of Family Court, Jalna. So also, the present non-applicant has filed Petition No. E.R. 39 of 2024 before the learned Family Court, Jalna for recovery of maintenance amount granted by the trial Court on 17.05.2024 in Petition No.E-159 of 2023. Therefore, considering the convenient of the applicant, it would be just and proper to withdraw the Petition No.A-436 of 2024 from the file of learned Family Court, Aurangabad and to transfer the same to the file of learned Family Court, Jalna. In view of above, I proceed to pass the following order:-

O R D E R

(i) The Miscellaneous Civil Application is allowed. (ii) Petition No.A-436 of 2024, pending on the file of the learned Principal Judge, Family Court, Aurangabad, is hereby withdrawn and transferred to the file of learned Family Court, Jalna.
