The learned counsel appearing for the applicant made a statement that, during the pendency of the present application, the non-applicant died on 17.02.2026.

Needless to say that by the present application under section 24 of the Civil Procedure Code, the applicant wife is seeking transfer of PetitionNo. A373 of 2024 from the file of learned Family Court, Solapur to the file of learned Civil Judge, Senior Division, Shrirampur, DistrictAhmednagar. 3.

On perusal of the record, it appears that the non applicant husband has filed Petition No. A-373 of 2024 under Section 9 of the Hindu Marriage Act and prayed for decree of restitution of conjugal rights against the present applicant wife. Since the non applicant/ original applicant is died, the cause of action does not survive in the present application as well as in Petition No.A-373 of 2024. 4.

In view of the above, the present Misc. Civil application is disposed of.
