The petitioner has filed this Contempt Petition alleging breach of clause 6(iii) of the order passed by this Court on 1 August 2024, whereby the respondents were directed to pay backwages within a period of two months from the said date. 2.

The respondent has filed an affidavit in reply. In paragraph 8 of the affidavit, it is stated that the amounts mentioned in the tabular form at serial numbers 1 to 6 have already been paid. However, the amount referred to at serial number 7 of the tabular form is still pending.

The learned Advocate for the respondent, on instructions, submits that approval for payment of the said leave encashment amount has been granted and the said amount shall be paid within a period of four weeks from today.

The statement made by the learned Advocate for the respondent is accepted as an undertaking to this Court. 5.

In view of the statement contained in paragraph 8 of the affidavit-in-reply and the statement made before this Court regarding payment of the amount at serial number 7 of the tabular form, no further adjudication is required in this petition. 6.

Accordingly, the Contempt Petition stands disposed of. 7.

However, in the event the respondent fails to comply with the undertaking recorded hereinabove, it shall be open to the petitioner to institute a fresh contempt petition. (AMIT BORKAR, J.)
