By way of this application, the applicant is praying for transfer of a criminal proceeding from the Court of learned JMFC, Akola to the Court of learned JMFC, Dhule.

At the outset, this Court made a query about maintainability of this application before this Court, as the proceeding sought to be transferred is Criminal Application. Learned Advocate for the applicant relies on order passed in Misc. Civil Application No. 112 of 2020 dated 24.08.2021. This Court in the said application dealt with this issue. It is held that the proceeding under the Protection of Women from Domestic Violence Act is in the nature of quasi-civil proceeding and therefore this Court can pass order of transfer.

In view of the above, issue notice to the respondents, returnable on 31.07.2025.

Since the age of the applicants is 80 and 78 years respectively, this Court finds that it is difficult for them to travel to Akola. 05.

In the meantime, there shall be ad-interim relief in terms of prayer clause (iv).
